Terms of Service for Arol CapitalLast Updated: October 19, 2025These Terms of Service ("Terms") govern your use of the AI Receptionist setup and management services (the "Services") provided by Arol Capital ("Arol Capital", "we", "us", or "our").By remitting the initial payment and using our Services, you or the entity you represent ("you" or "Client") agree to be bound by these Terms.1. Description of Services
Arol Capital provides setup, customization, and deployment of an AI-powered voice agent ("AI Receptionist") for businesses, primarily for handling lead intake, answering customer calls, and booking appointments. The specific scope of the setup will be agreed upon before the initial payment.2. Fees, Payment, and Refunds
2.1. Service Fee: The total fee for the setup of the AI Receptionist (the "Service Fee") shall be the amount quoted to the Client by Arol Capital prior to the engagement and as specified in the service invoice or agreement. All fees are in United States Dollars (USD).2.2. Payment Structure: The Service Fee is a monthly rate that will be set up as an automatic payment charged to the Client's credit card.2.3. Refund Policy: If Arol Capital fails to deliver a fully complete AI Receptionist within thirty (30) days of receiving the Initial Payment, the Client is entitled to request and receive a full refund of their payment.3. Client Data and Ownership
3.1. Data Ownership: The Client retains all right, title, and interest in and to all data, information, and content collected from end-users by the AI Receptionist in the course of providing the Services (the "Client Data"). This includes, but is not limited to, lead information, call content, and appointment details.3.2. License to Arol Capital: The Client grants Arol Capital a limited, non-exclusive, non-transferable license to access, use, and process the Client Data solely for the purpose of providing, maintaining, and improving the Services for the Client.4. You agree to defend, indemnify, and hold harmless Arol Capital and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:(i) your use of and access to the Services;(ii) your violation of any term of these Terms;(iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right.8. Governing Law and Dispute Resolution
8.1. Governing Law: These Terms shall be governed and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.8.2. Dispute Resolution: Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, shall be determined by final and binding arbitration.
